Elin Morgan

OVERVIEW
Elin was called to the Bar by the Honourable Society of Gray’s Inn in 2023. She joined Chambers as a tenant in 2024 following the successful completion of pupillage under the supervision of Clare Wilks and Andrew Kendall.
Elin is bilingual and takes regular instructions in both Welsh and English.
Elin accepts instructions in all Chambers’ practice areas. She regularly defends and prosecutes on behalf of local authorities, the Crown Prosecution Service and police forces in a wide range of cases within the Crown Court and Magistrate’s Court.
Elin has also developed a strong practice in professional discipline, with experience both prosecuting and defending in hearings before Fitness to Practice committees for both the Education Workforce Council and the Nursing and Midwifery Council.
Prior to joining Chambers, Elin read Law at the University of Birmingham, graduating with a First-Class degree in 2022. She then went on to study the Bar Training Course with Masters in Law from Cardiff University, graduating with Distinction.

Criminal Cases
R v M [2025] (Cardiff Crown Court) - Elin defended in a trial for an offence of intentional strangulation which involved elements of bribery to make false allegations. The Defendant suffered with complex mental health issues including Post Traumatic Stress Disorder.
R v W [2025] (Cardiff Crown Court) - Elin defended a trial involving sexual offences committed against children.
R v A [2025] (Cardiff Magistrates’ Court) - Elin prosecuted a case involving domestic violence where the victim actively gave evidence in support of the defendant, who was subsequently convicted.
R v P [2025] (Cardiff Crown Court) - Elin’s client faced a prosecution by the Home Office and subsequent deportation.
R v M&N [2025-2026] (Bristol Crown Court) - Elin prosecutes in a two-handed trial involving allegations of Being Concerned in the supply of Class A Drugs. The first Defendant was assessed by a psychiatrist who looked at fitness to plead and fitness to stand trial.
R v B [2026] (Cardiff Crown Court) - Elin defends in a trial of Causing Serious Injury by Careless Driving.
R v S [2024] (Cardiff Crown Court) - Elin successfully represented her client in an appeal against sentence. The single mother was immediately released following Elin’s submissions.
R v R [2025] (Llanelli Magistrates’ Court - Welsh language) - Elin defended a young Defendant who faced domestic abuse allegations. The trial was conducted in Welsh.
Proceeds of Crime
R v B [2025] (Cardiff Crown Court) - Elin prosecuted a Defendant facing charges of Possession with Intent to Supply of Class B and C drugs, and an application was made under the Proceeds of Crime Act 2002. The Defendant was found to have benefitted from over £350,000 from the offending.
R v S [2025] (Newport Crown Court) - Elin prosecuted a Defendant facing charges of fraud. Following sentence, an application was made under the Proceeds of Crime Act.
R v D [2026] (Merthyr Tydfil Crown Court) - Elin was briefed as junior counsel in a multi-handed drug conspiracy when dealing with Proceeds of Crime. The Defendant was found to have benefited from over £110,000 from the offending.
Local Authority
Merthyr Tydfil County Borough Council v R [2024] (Merthyr Tydfil Crown Court) - Elin, on behalf of her client, successfully appealed a noise abatement notice issued by the Council, undermining the Council’s expert evidence.
Blaenau Gwent County Borough Council v C&T [2025] (Newport Magistrates’ Court) - Elin prosecuted two co-defendants facing allegations of cruelty of a large number animals.
Blaenau Gwent County Borough Council v C [2026] (Newport Magistrates’ Court) - Elin represents the Council in a case involving prosecutions under the Environmental Protection Act 1990. The case involves legal arguments surrounding lawful use of covert surveillance.
Swansea City & County Council v H [2025] (Swansea Magistrates’ Court) - Elin successfully argued for the closure of a convenience store selling counterfeit tobacco and selling tobacco and vapes to children.
Merthyr Tydfil County Borough Council v M [2026] (Merthyr Tydfil Magistrates’ Court) - Elin prosecuted a case involving the making of a Food Hygiene Order for a convenience store.

Nursing and Midwifery Council v S [2024] - Elin prosecuted a nurse before the Fitness to Practice Committee for concerns regarding their competence.

Misconduct concerns
Education Workforce Council v P [2024] - Elin defended her teacher client in a final hearing before the Education Workforce Council after being convicted of driving with excess alcohol on the way to school. The hearing was conducted in Welsh. The teacher was given the lowest level of reprimand.
Nursing and Midwifery Council v A [2024] - Elin prosecuted a nurse before the Fitness to Practice Committee for allegations of misconduct at work.

International Criminal Law
TSP v J [2024-2025] (International Criminal Court, the Netherlands) Elin supported Specialist Leading Council and Junior Counsel in the International Criminal Court, instructed by Kosovo Specialist Chambers in an International Criminal law case held in The Hague, Netherlands. This case related to offences of historic war crimes.
Exceptional Hardship Arguments
R v P [2024] (Cwmbran Magistrates’ Court) - Elin made a successful ‘exceptional hardship’ argument, ensuring the sole earner of the family kept his drivers licence.
R v H [2025] (Merthyr Tydfil Magistrates’ Court) - Elin made a successful ‘exceptional hardship’ argument, ensuring a carer could retain his drivers’ licence during his father’s palliative care.
Taxi Licensing
Blaenau Gwent County Borough Council v R [2025] (Newport Magistrates’ Court) - Elin represented the Council in an appeal against the revocation of a taxi licence.
Police Prosecutions
South Wales Police v S [2024] (Newport Magistrates’ Court) - Elin represented South Wales Police in a prosecution under the Dangerous Dogs Act 1991.
South Wales Police v J [2026] (Swansea Magistrates’ Court) - Elin represented South Wales Police in a prosecution for a breach of a Sexual Risk Order.
South Wales Police v R [2025] (Newport Magistrates’ Court) - Elin successfully applied on behalf of South Wales Police for the closure of a residential property being used for sexual exploitation and drug use.
Pro Bono
R v N [2024] Elin provided free legal advice to an individual who did not qualify for legal aid and was struggling to understand the law surrounding the offences alleged against him.
